Public Comments Solicited on Revised “Part 2” SUD Privacy Regulations

On December 2, the Department of Health and Human Services published proposed changes to confidentiality rules for substance use disorder treatment records under 42 CFR Part 2.  An announcement summarizes the proposed changes which are intended to increase coordination among multiple providers serving a single patient, and to increase protections against prohibited disclosure of patient records.

NACBH members serving children and families dealing with addiction disorders are encouraged to review the draft regulatory language.  It was authorized by the Coronavirus Aid, Relief, and Economic Security (CARES) Act to bring Part 2 requirements into greater alignment with HIPAA rules.
